Feeder Show Series & Final Verdict Online Motorcycle Show

("Competition")

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING IN ANY FEEDER SHOW OR THE FINAL VERDICT ONLINE MOTORCYCLE SHOW. BY SUBMITTING AN ENTRY OR VOTING, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS IN THEIR ENTIRETY.

1. SPONSOR AND ADMINISTRATOR

This Competition is sponsored and administered by Metier Law Firm, located at 4820 South College Ave., Fort Collins, CO (“Sponsor”). All decisions made by Sponsor regarding this Competition are final and binding in all respects.

2. ELIGIBILITY

The Competition is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age at the time of entry. VALID GOVERNMENT-ISSUED PHOTO IDENTIFICATION (such as a state driver’s license, state ID card, or U.S. passport) WILL BE REQUIRED TO VERIFY AGE AND IDENTITY PRIOR TO ENTRY INTO ANY FEEDER SHOW AND PRIOR TO PRIZE DISBURSEMENT. Any individual who is unable or unwilling to provide satisfactory proof of age and identity upon request will be deemed ineligible and may be refused entry or disqualified. Employees, officers, directors, agents, and representatives of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and members of their immediate families (spouse, parents, siblings, children) or household members are NOT eligible to participate as entrants. Void where prohibited or restricted by law.

Motorcycles entered must be legally registered and owned or co-owned by the entrant.

3. COMPETITION STRUCTURE

The Competition is conducted in two (2) phases:

  • Phase 1 – Feeder Shows: A series of ten (10) in-person motorcycle shows (“Feeder Shows”) held in Colorado, Washington, and Oregon. The dates, locations, and specific entry requirements for each Feeder Show will be announced by Sponsor at least five (5) days prior to each event. Sponsor reserves the right, in its sole and absolute discretion, to add, remove, postpone, or cancel individual Feeder Shows at any time without prior notice and without liability to any entrant or prospective entrant.

FORCE MAJEURE – FEEDER SHOWS: If any Feeder Show is prevented, delayed, or otherwise unable to take place as scheduled due to causes beyond Sponsor’s reasonable control, including but not limited to acts of God, natural disasters, fire, flood, earthquake, severe weather, epidemic, pandemic, governmental orders or restrictions, venue closure, strikes, civil unrest, terrorism, or failure of essential services (each, a “Force Majeure Event”), that Feeder Show will be deemed cancelled and will NOT be included in or recognized as part of the Final Verdict Feeder Show system for that competition year. No Judges’ Choice winner will be selected from a cancelled Feeder Show, and no automatic entry into the Final Verdict will be awarded in connection with that show. Sponsor shall have no liability to any entrant, participant, or third party arising out of the cancellation of a Feeder Show due to a Force Majeure Event. There will be no carry-over of cancelled Feeder Show slots to future competition years unless expressly stated by Sponsor in writing.

  • Phase 2 – Final Verdict Online Show: The annual online championship show (“Final Verdict”) in which Feeder Show winners compete for the Grand Prize. The Final Verdict will be conducted online at www.finalverdictshow.com.

4. FEEDER SHOW ENTRY AND JUDGING

Entry into each Feeder Show is governed by that Feeder Show’s specific entry rules and any applicable entry fees, which will be published separately. One (1) Judges’ Choice winner will be selected per Feeder Show by a panel of qualified judges appointed by Sponsor. Judging criteria may include but are not limited to: craftsmanship, originality, theme execution, and overall presentation. All judging decisions are final and not subject to appeal. Sponsor reserves the right to disqualify any entry that it determines, in its sole and absolute discretion, does not comply with applicable rules or standards of conduct.

INDEPENDENCE OF FEEDER SHOW JUDGING: The Final Verdict online show has absolutely no influence over, participation in, or authority with respect to the selection of Judges’ Choice winners at any Feeder Show. Each Feeder Show is independently judged by its own panel, and the Judges’ Choice selection process is entirely separate from and unaffiliated with the Final Verdict show and its administration. The invitation to participate in the Final Verdict constitutes the independent prize awarded by each Feeder Show and is determined solely at the Feeder Show level. No entity associated with the administration or promotion of the Final Verdict shall have any role in evaluating or selecting Feeder Show entrants or winners.

5. AUTOMATIC ENTRY INTO FINAL VERDICT

Each Judges’ Choice winner from a Feeder Show is automatically entered into the Final Verdict at no additional cost. Automatic entry does not guarantee a prize. Winner must confirm participation in the Final Verdict by a deadline determined by each individual Feeder Show, as communicated to the winner at the time of the award, or their entry may be forfeited at Sponsor’s sole discretion.

Should a Judges’ Choice winner decline entry into the Final Verdict, or fail to confirm participation within the required timeframe, Sponsor reserves the right to select an alternate entrant from that Feeder Show. The alternate will be the next-highest scored entry from that Feeder Show as determined by the judging panel. The alternate will be bound by all applicable Terms and Conditions.

Each Judges’ Choice winner will receive a formal invitation to appear in person at the Final Verdict show. Acceptance of this invitation is entirely optional and is extended as a courtesy only. ALL TRAVEL, LODGING, TRANSPORTATION, MEALS, AND ANY OTHER COSTS ASSOCIATED WITH IN-PERSON ATTENDANCE AT THE FINAL VERDICT ARE SOLELY THE RESPONSIBILITY OF THE JUDGES’ CHOICE WINNER AND ARE NOT PART OF ANY PRIZE PACKAGE. Sponsor assumes no liability for any expenses incurred in connection with in-person attendance.

FOR THE AVOIDANCE OF DOUBT: The Judges’ Choice award at each Feeder Show carries no monetary value and includes no additional prizes, gifts, or compensation of any kind. The sole benefit of the Judges’ Choice award is an automatic invitation to participate in the Final Verdict online show as described herein.

6. FINAL VERDICT ONLINE SHOW – VOTING

The Grand Prize winner of the Final Verdict will be determined by online popular vote during the Voting Period. The Voting Period opens at 12:00 PM (Noon) Pacific Standard Time (PST) on Thursday, October 8th, and closes at approximately 1:00 PM PST on Saturday, October 10th (“Voting Period”).

NOTICE REGARDING CLOSING TIME: The closing time of the Voting Period is approximate and may vary due to technical, administrative, or other circumstances beyond Sponsor’s reasonable control. Sponsor reserves the right, in its sole and absolute discretion, to extend, shorten, or otherwise modify the closing time of the Voting Period without prior notice. Votes submitted after the official close of the Voting Period, as determined by Sponsor, will not be counted regardless of when they were initiated. Sponsor’s determination of the precise closing time and the validity of any votes cast near the closing time is final and binding.

  • Voting is open to any individual who meets eligibility requirements.
  • Each eligible voter may cast one (1) vote per day, per registered account, during the Voting Period.
  • Votes must be cast via the official voting mechanism at www.finalverdictshow.com. Votes submitted by any other method will not be counted.
  • Sponsor will make every reasonable effort to ensure the integrity of the online voting process and to detect and disqualify fraudulent, automated, scripted, or otherwise illegitimate votes. Specific fraud-prevention measures employed include, but are not limited to: (a) IP address monitoring and limits to restrict multiple votes from a single internet connection; (b) mandatory email-based account registration and verification prior to voting, with one (1) verified account permitted per person; and (c) CAPTCHA or equivalent human-verification technology to prevent automated voting. However, SPONSOR MAKES NO WARRANTY OR GUARANTEE THAT ALL FRAUDULENT VOTES WILL BE DETECTED OR PREVENTED, AND SHALL NOT BE LIABLE FOR ANY FAILURE TO DO SO.
  • Any attempt to manipulate the voting process, including but not limited to the use of bots, scripts, vote-buying, soliciting votes through mass commercial messaging, or other automated or deceptive means, is strictly prohibited and may result in disqualification of the associated entrant.
  • Sponsor reserves the right, in its sole and absolute discretion, to disqualify votes it determines to be fraudulent, or to void the results of and re-conduct the voting if Sponsor determines the integrity of the voting process has been materially compromised.
  • Sponsor’s determination as to the validity of any vote or the outcome of the Final Verdict is final and binding.

7. GRAND PRIZE

One (1) Grand Prize of Five Thousand Dollars ($5,000.00 USD) will be awarded to the Final Verdict online vote winner. Prize will be paid by check within fifteen (15) business days of winner verification and satisfaction of all award conditions. The Grand Prize is non-transferable and no substitution or cash equivalent will be awarded, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the stated prize becomes unavailable for any reason.

IN THE EVENT OF A TIE: If two (2) or more entries finish the Voting Period with an equal number of verified votes, the Grand Prize of $5,000.00 USD will be divided equally among all tied entrants. Each tied entrant will receive their pro-rata share of the Grand Prize, rounded down to the nearest whole dollar. No additional prizes will be awarded in a tie scenario. All tied entrants will be considered co-winners for all purposes under these Terms and Conditions, including tax reporting obligations.

All federal, state, and local taxes on the prize are the sole responsibility of the winner. Winner will be required to complete IRS Form W-9 or equivalent tax documentation within thirty (30) days of prize notification. FAILURE TO PROVIDE REQUIRED TAX DOCUMENTATION WITHIN THIRTY (30) DAYS SHALL RESULT IN AUTOMATIC FORFEITURE OF THE PRIZE IN ITS ENTIRETY, WITH NO FURTHER OBLIGATION BY SPONSOR. Additionally, if a winner is found at any time to have engaged in fraud, misrepresentation, manipulation of the voting process, or any violation of these Terms and Conditions, Sponsor reserves the right to immediately forfeit and reclaim the prize, and the winner shall be required to return any prize funds already disbursed upon written demand by Sponsor.

8. WINNER NOTIFICATION AND VERIFICATION

The potential Grand Prize winner will be announced live during the Final Verdict online show and subsequently notified by email and telephone within fifteen (15) business days of the close of the Voting Period. Potential winner must respond within fifteen (15) business days of notification or prize may be forfeited and awarded to an alternate. Prior to awarding any prize, Sponsor may require the potential winner to provide identification, and execute an Affidavit of Eligibility, Liability Release, and (where legally permissible) a Publicity Release. Failure to return required documents within the specified timeframe, or if any prize notification is returned as undeliverable, may result in disqualification and alternate winner selection.

9. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • SPONSOR, ITS AFFILIATES, SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, “RELEASED PARTIES”) ARE NOT RESPONSIBLE FOR: (A) LOST, LATE, MISDIRECTED, DAMAGED, INCOMPLETE, OR ILLEGIBLE ENTRIES OR VOTES; (B) TECHNICAL FAILURES OF ANY KIND, INCLUDING BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN PHONE LINES, INTERNET ACCESS, OR NETWORK HARDWARE OR SOFTWARE; (C) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE COMPETITION; (D) TECHNICAL OR HUMAN ERROR IN THE ADMINISTRATION OF THE COMPETITION OR PROCESSING OF ENTRIES OR VOTES; OR (E) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY THAT MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM ENTRANT’S PARTICIPATION IN THE COMPETITION.
  • THE RELEASED PARTIES EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH RESPECT TO THIS COMPETITION AND ANY PRIZES.
  • IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS COMPETITION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • THE RELEASED PARTIES’ TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THIS COMPETITION SHALL NOT EXCEED THE VALUE OF THE GRAND PRIZE ($5,000.00 USD).

10. RELEASE

By entering the Competition or casting a vote, each entrant and voter (as applicable) agrees to release, discharge, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) participation in the Competition; (b) acceptance, possession, use, or misuse of any prize; (c) any violation of these Terms and Conditions; or (d) any act or omission by Sponsor in administering the Competition.

11. ENTRY CONDUCT AND CONTENT

Entrants are solely responsible for their motorcycles and any materials submitted in connection with their entries. Entrant represents and warrants that: (a) the entry is the entrant’s own original work or that entrant has all necessary rights and permissions to submit the entry; (b) the entry does not infringe upon any third-party intellectual property rights, privacy rights, or other proprietary rights; (c) the entry is not defamatory, obscene, or otherwise unlawful. Sponsor reserves the right to disqualify any entry it determines, in its sole discretion, violates any of the foregoing or is otherwise objectionable. Entrant grants Sponsor a perpetual, royalty-free, non-exclusive license to use, reproduce, publish, display, and distribute photographs and descriptions of the entrant’s motorcycle entry for promotional and marketing purposes in connection with the Competition, without further compensation.

THIRD-PARTY ARTWORK AND INTELLECTUAL PROPERTY: Entrant acknowledges that motorcycles entered in the Competition may incorporate custom paint, graphics, artwork, logos, characters, or other creative elements that are or may be subject to third-party copyright, trademark, or other intellectual property protections. Entrant expressly represents and warrants that: (a) entrant has obtained all necessary licenses, permissions, and consents from any and all rights holders for any third-party intellectual property incorporated into or displayed on the entered motorcycle; and (b) the display, reproduction, or publication of the entry by Sponsor for any promotional or Competition-related purpose will not violate any third-party intellectual property rights. Entrant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to any alleged or actual infringement of third-party intellectual property rights in connection with entrant’s entry. Sponsor reserves the right to disqualify any entry it reasonably believes may incorporate unlicensed third-party intellectual property.

12. PRIVACY

Personal information collected in connection with the Competition will be used by Sponsor for administration of the Competition and as described in Sponsor’s Privacy Policy, available at www.finalverdictshow.com/privacypolicy. By participating, entrants and voters consent to such use. Sponsor will not sell personal information to third parties except as necessary to administer the Competition or as required by law.

13. PUBLICITY

Except where prohibited by law, participation in the Competition constitutes winner’s consent to Sponsor’s use of winner’s name, likeness, photograph, voice, and hometown for promotional purposes in any media without further compensation or notice.

14. DISPUTES AND GOVERNING LAW

These Terms and Conditions shall be governed exclusively by and construed in accordance with the laws of the State of Colorado, without regard to its conflict-of-law provisions, and regardless of the state or country in which any entrant or voter resides or participates. The parties expressly agree that Colorado law shall apply to all disputes, claims, and controversies arising out of or relating to this Competition. Any dispute, claim, or controversy arising out of or relating to this Competition or these Terms and Conditions that cannot be resolved informally shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and judgment on the award may be entered in any court of competent jurisdiction. THE PARTIES WAIVE ANY RIGHT TO A JURY TRIAL. Any arbitration shall take place in Fort Collins, Colorado, and shall be conducted on an individual basis. CLASS ACTION ARBITRATION IS NOT PERMITTED. Entrants and voters who are residents of Colorado, Washington, or Oregon acknowledge that by participating they consent to personal jurisdiction in the State of Colorado and waive any objection to venue in Larimer County, Colorado.

15. GENERAL CONDITIONS

  • Sponsor reserves the right to cancel, suspend, or modify the Competition in whole or in part, at any time, for any reason, including but not limited to fraud, technical failures, or any other factor beyond Sponsor’s reasonable control that compromises the integrity of the Competition.
  • Sponsor’s failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision.
  • If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • These Terms and Conditions constitute the entire agreement between the entrant and Sponsor with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals.
  • These Terms and Conditions may not be amended except by a written instrument signed by an authorized representative of Sponsor.
  • Sponsor is not responsible for typographical or other errors in the printing, offering, or administration of the Competition.
  • SOCIAL MEDIA AND THIRD-PARTY PLATFORM DISCLAIMER: This Competition is in no way sponsored, endorsed, administered, or associated with any social media platform or third-party website, including but not limited to Meta (Facebook and Instagram), X (formerly Twitter), TikTok, YouTube, or any other platform through which the Competition may be promoted or shared. By participating, each entrant and voter completely releases all such platforms from any and all liability in connection with this Competition. Any questions, comments, or complaints regarding the Competition should be directed to Sponsor at the contact information provided in these Terms and Conditions, and not to any third-party platform.
