Can Food Be Recalled?

Most product liability cases involve defective components in automobiles, dangerous toys, hazardous appliances and defective pharmaceuticals. However, the food industry can also produce faulty products that can harm consumers. Businesses at all different levels of production and distribution can be liable for failing to follow standardized timing and temperature procedures, resulting in spoiled or poisonous foods. Given the vast distribution network of the food industry, a defective product can cause illness and death across the nation.

According to the Centers for Disease Control and Prevention (CDC), the Delaware-based Roos Foods of Kenton has been linked to an outbreak of Listeria monocytogenes in multiple states. CDC investigators used DNA sequencing to link the strain of Listeria to cheese produced by Roos Foods. One person has died in California and seven more are gravely ill in Maryland.  Five of the seven in Maryland were pregnant, and Listeria has infected two of the five unborn children. Roos Foods has recalled 16 different varieties of cheese after learning of the outbreak.
