Medical Malpractice
When you use the services of a professional, such as a doctor, nurse, or therapist, you expect them to uphold the highest standard of care in your case – to take care of you and your illness or injury so that you have every reasonable expectation of getting better. But if you have a treatment, are prescribed medication, or have surgery and find that you are doing much worse, you may be the victim of medical malpractice.
Medical malpractice can be a little difficult to understand. If you go to a doctor and do not get well, it is not necessarily due to medical malpractice. Every medical case is different and every person is different, so it follows that every treatment may not work the same way for everyone. However, if your medical professional fails to follow set standards of care and it causes you to get worse, that probably is a case of medical malpractice. Examples of this include missing a diagnosis that is fairly common, leaving a sponge or surgical instrument inside of you during surgery, failing to prescribe a commonly prescribed medication for a particular condition, or not following basic procedures when dealing with a particular illness. In each of these cases, you notice that the one thing they all have in common is that something that should have been done or that should have been obvious wasn’t done or was ignored. When this violates the standard of care in the medical community, it constitutes malpractice.
